  • Road accidents are common in all states and territories of Australia. It is important that you know your legal obligations and responsibilities.
  • First and foremost when you are in an accident you must stop and assist. This is the case even if the accident is minor and it appears no damage has been done. You and the other driver must exchange details. This may be needed later for any insurance claims for property damage and repair or injury.
  • Leaving the scene of an accident without stopping to exchange details is an offence.
  • In some situations the police may attend the scene in order to interview you or another driver including any witnesses. At this stage either driver may be given a fine or charged with an offence if the police believe that one has occurred.
  • If you are responsible for causing an accident you will be responsible for any resulting damage. If you are adequately insured your insurance company will handle the claim and you may only be liable for any excess amount. If you are not properly insured then you may be personally liable for the damage.
  • If a person has been injured in the accident then the Transport Accident Commission (TAC) in Victoria or the equivalent in your state or territory may become involved. The TAC and other similar bodies are responsible for administering medical costs for individuals who have been injured.
