    10. Demerit Points
  • Police can also issue demerit points to a person who has committed a driving offence.
  • Any demerit points you receive for driving offences will be recorded on your driving record.
  • Different licence types have different threshold limits with most unrestricted licence holders having 13 points.
  • If you receive more than the allowed number of demerit points over a 3 year period your licence will be cancelled or suspended. When this happens you will be notified in writing by the NSW Roads and Maritime Services (RMS) or the equivalent authority in your state or territory.
  • The period of suspension will be affected by the number of demerit points that you have accumulated.
  • If you receive a notification of suspension from the RMS or its equivalent you may be eligible to make an application for a 12 month good behaviour bond instead of serving the suspension period. This is not available if you have already served a good behaviour bond for driving offences. You must take steps to request a 12 month good behaviour bond prior to the suspension period coming into effect.
  • Whilst on a good behaviour bond you will only have 2 demerit points. If you commit further offences beyond the two demerit points your licence will be cancelled for double the initial period.
  • You cannot appeal against a decision to suspend your licence because of incurring too many demerit points.
  • At no stage will demerit points be deleted.
  • Overtime they will age and there comes a time when they will not be counted in any calculation of your demerit points. This is generally after 40 months.
