- There is no legal obligation for an executive committee to meet a certain number of times in a year. The secretary may be required to organise a meeting at any time if requested to do so by one-third of the committee members.
- If you are a lot owner and member of the owners’ corporation you are entitled to attend the executive committee meetings but you cannot speak unless permitted.
- Minutes of each meeting must be provided within 7 days of the meeting to each owner.
- Decisions made by the executive committee are usually treated as decisions of the owners’ corporation but in times of conflict a decision of the owners’ corporation will prevail.
- The executive committee cannot make certain decisions on behalf of the owners’ corporation including:
- decisions requiring a large amount of money to be spent; and
- decisions that require a unanimous resolution, a special resolution or which need to be made in a general meeting.
