9. Executive Committee

- An executive committee is a team of members of an association who act as representatives of each subsidiary association.
- The committee usually consists of a chairperson, secretary and treasurer plus up to six other members. You cannot have more than 9 members in an executive committee.
- There are rules that govern eligibility for election as a member of the executive committee and these rules differ depending on whether the executive committee is for a community, precinct or neighbourhood scheme.
- As community schemes are large and complex structures of subdivision that encompass many lot owners it is essential for an executive committee to be formed at the first annual general meeting.
- An application can be made to an adjudicator for an order to appoint the committee if an executive committee is not formed.
- Sections 29 and 30 of the Community Land Management Act 1989 (NSW) outline eligibility requirements for candidates wanting to stand for election to community, precinct or neighbourhood executive committees.
- If you are considering standing for election to an executive committee it is a good idea to speak to a lawyer about your rights to stand for election and your obligations and responsibilities if elected.
- Members of the executive committee may be paid for their work in an amount determined at an annual general meeting.
