    11. Association Meetings
  • In community living issues invariably arise that need to be addressed. This can be done by the association holding an annual general meeting (AGM) or a special general meeting.
  • An AGM must be held annually.  It must be within 11-13 months of the previous AGM. At an AGM the agenda usually calls for important issues to be discussed including:
    • insurance;
    • finances;
    • election of an executive committee;
    • review of the sinking fund plan; and
    • any motions that require a unanimous or special resolution.
  • Special general meetings can be held whenever necessary during the year. At a special general meeting the issues on the agenda may include:
    • the amendment, repeal or addition of by-laws;
    • changes to the management statement; and
    • any other general business arising from the day to day operation of the scheme.
  • If you have an issue that you want the association to address at a meeting you have to:
    • ensure that all your levies are paid and that your name is on the community roll. This means that you are entitled to vote;
    • request the executive committee to convene a general meeting. If the majority of the executive committee vote against convening a meeting you can supply the secretary with a written request signed by people who hold at least one-quarter of the total unit entitlements for that scheme collectively and are entitled to vote. On receipt of such a request the secretary must convene a general meeting; and
    • provide the secretary with written notice of your motion which will be put on the agenda for the next general meeting. Issues that are not on the agenda can still be discussed at a meeting but you will have to wait till the next meeting to vote on the motion. If the secretary fails to put your proposed motion on the agenda you can bring up the issue at the meeting and ask for it to be put on the next general meeting’s agenda or initiate mediation proceedings.
