11. Damage Caused by Aircraft

- A court may award monetary damages to you for any injury or loss caused by an aircraft. You may also be compensated if the damage or destruction is caused as a direct result of passengers, animals or things that are dropped or that have fallen from the aircraft.
- The owners or operators of the aircraft will be liable in the event that you suffer personal injury or death or if your personal property is destroyed or damaged as a result of an impact with an aircraft.
- In these circumstances you do not need to prove that the injury or loss was intended or that it happened as a result of negligence. The injury or loss need not have been a consequence of a deliberate act or omission on the part of a pilot, cabin crew member or passenger.
- If the damage is caused by the aircraft or by something falling from the aircraft then you may be able to claim monetary damages.
