4. Overseas Lawyers in Australia

- Where an overseas-qualified lawyer is not admitted to practice in Australia they may only practise the law of their own country in Australia.
- An overseas lawyer may be required to register as a foreign lawyer with the law society or institute of the state or territory in which they will be working.
- Internationally trained lawyers who are practicing foreign law in Australia are subject to the same ethical and practice standards as all Australian lawyers once they have registered.
- If the overseas lawyer intends to practise in an area requiring the use of Australian law they will be required to obtain an Australian practising certificate.
- Some exceptions exist where an overseas lawyer is only going to be spending a short amount of time undertaking legal practise in Australia.
- You should contact the relevant law society or institute for specific information about any requirements to practise in their jurisdiction.
