- Disability service providers and their employees owe their clients a duty of care.
- If they breach that duty of care then they can be liable for any harm, loss or injury that directly results from that breach.
- A duty of care requires a person to exercise the care that a ‘reasonable person’ would exercise in the same circumstances.
- The standard of care expected will vary according to the circumstances of the particular case.
