WWorkplace Injury Law Overvieworkplace injury is a general term that refers to any physical or psychological injury, disease, disorder or illness that arises out of an employee’s employment. Examples of injuries include:

  • physical injuries such as cuts, bruises, fractures or broken bones;
  • psychological disorders such anxiety or depression;
  • diseases such as mesothelioma or cancer;
  • aggravation of pre-existing conditions; and
  • death from an injury or disease.

An injury may be classified as a ‘workplace injury’ and you may be eligible to receive compensation if your injury arises while you are:

  • at work either in the office or working from home;
  • while on a lunchbreak at work;
  • travelling for work-related purposes such as a business trip; or
  • travelling to and from work.

If you have suffered a workplace injury that affects your ability to carry out normal duties you may be required to participate in an injury management program. This program may include:

  • rehabilitation;
  • a suitable duties program; and
  • ultimately a plan for your return to work.

The program is very closely linked with workers compensation schemes as your compliance with the injury management program is generally an ongoing condition of receiving workers compensation payments. For this reason it is important that both you and your employer co-operate and work cohesively together to comply with your respective obligations under the program.
