  • For serious driving and traffic offences the police may decide to charge you. This can be done in two ways:
    • by issuing you with a ‘charge and summons’ to appear at court; or
    • by arresting you.
  • If you have been issued with a summons or arrested you should seek legal advice immediately. You can Find a Lawyer near you by using our free directory.
  • If you receive a summons to appear in court then you must attend court on the set date. The summons can be given to you personally or by mail.
  • If you are arrested the police will charge you and you can make an application for bail.
  • If you are released on bail read the conditions carefully and make sure you clearly understand them. If you have any doubts or do not understand your bail conditions raise the issue immediately with the police or the court and your lawyer.
  • Make sure you give your lawyer copies of the following documents:
    • the charge sheets;
    • any police statements;
    • any criminal or traffic history;
    • any bail documents;
    • any other documents or photographs that:
      • have been given to you by the police; or
      • may be relevant to your case.
