11. Other Driving Offences

- The Road Rules 2008 (NSW) apply to all road users. Any breach of the Road Rules can result in a Traffic Infringement Notice (traffic ticket).
- The types of offences that are dealt with in the Road Rules include:
- failing to stop at a red light;
- speeding;
- failing to indicate;
- failing to stop at a ‘Stop’ sign;
- failing to give way.
- Drivers also have a duty of care towards other people who use the road. There are a number of offences in the Road Safety Act 2013 (NSW) that relate to the safety of the public whether or not an accident has occurred:
- negligent driving is the least serious of these offences and includes:
- failing to take adequate care and attention whilst you are driving;
- failing to keep the proper distance between you and the car in front; and
- failing to keep a proper lookout;
- driving furiously or recklessly;
- driving at a speed or in a manner dangerous to the public;
- drag racing;
- menacing driving where the driver’s manner of driving is intended to:
- threaten another person with personal injury; or
- threaten another person with damage to property;
- where there is a failure to secure a load properly and this results in:
- death;
- injury; or
- damage to property; and
- where a person who has been involved in a car accident or collision fails to stop and give assistance.
