Does the primary decision that I am seeking to have reviewed continue to operate while my application is heard?
- Yes. A decision usually continues to operate while it is being reviewed by the tribunal.
- However the tribunal may order that the decision be suspended during the review process.
- If you want the operation of the decision to be suspended you must make an application for an order of a ‘stay’ (pause) of the decision.
