Is ADR confidential?
- ADR processes are confidential. The main idea behind ADR is to provide confidential, efficient and cost effective solutions for people to resolve their disputes.
- This means that discussions you have in an ADR session cannot then be used as evidence in any future court cases.
- The most effective discussions will occur if both people feel comfortable about being open and honest and working towards a solution.
- There are some exceptions to the confidentiality rule such as if someone is at risk of harm. A lawyer or your ADR practitioner is the best person to give you advice about these exceptions.
