    4. Summons for Probate
  • After you have published your notice of application you will need to arrange for a summons for probate. In New South Wales you must use UCPR Form 111.
  • The summons is a formal application form that can be found on the NSW Supreme Court website if you are applying for probate yourself. Alternatively your solicitor will complete this form for you.
  • The summons will need to cover the relief claimed. The relief that you will generally be claiming is that you want probate of the will of the deceased to be granted to you.
  • The summons is filed with the Supreme Court 14 days after the publication of the notice of intended application on the online register.
  • Depending on your state or territory of residence the court will require different forms to be completed and lodged with the court. You will need to check the Supreme Court website for your particular state or territory.
