- The various states and territories have different tribunal systems.
- Victoria, the Australian Capital Territory, New South Wales, Queensland and Western Australia all have what are referred to as ‘super tribunals’ which hear a broad range of matters. The South Australian Civil and Administrative Tribunal will also resolve disputes and review decisions in a range of specialist areas from early 2015.
- The ‘super tribunals’ all have similar processes including:
- the matter for review or consideration or appeal must fall within the tribunal’s jurisdiction (authority) ;
- each tribunal has similar rules relating to the provision of relevant documents and other evidence;
- each tribunal organises conferences and attempts at mediation; and
- if no resolution can be reached between the parties a hearing is held to decide the matter on its merits.
