6. Breaches of a Licence

- If you breach a law or regulation then your local authority is likely to bring an action against you.
- In most states and territories the authority will initially work with you to find a solution to help you so that you do not breach the law again.
- It may be that your licence needs to be modified so you can comply with the law.
- It may be that you need to make some changes in the business.
- If an action is brought against you then the authority will need to decide on an appropriate punishment for your breach. They will consider a range of factors including:
- the severity of the breach;
- how much you are to blame for the breach;
- sanctions and costs that are appropriate in the circumstance; and
- whether your punishment will deter holders of other industry licences from breaking the law.
