    11. Witnesses at a Hearing
  • You may be called as a witness in a hearing to give evidence. You may be a witness for:
    • the objector;
    • the complainant; or
    • the applicant.
  • If you are a witness for an objector or a complainant then he or she will firstly question you. If they have a lawyer then the lawyer will speak on their behalf.
    • The applicant or their lawyer will then have a chance to ask you some questions.
    • The commissioners may also ask you questions.
  • If you are a witness in support of an applicant then he or she will firstly question you. If they have a lawyer then the lawyer will speak on their behalf.
    • The complainant or their lawyer will then have a chance to ask you some questions.
    • The commissioners may also ask you questions.
  • If you are giving evidence at a hearing you must enter the witness box and take an oath to tell the truth to the commission.
    • Usually the chairman or presiding commissioner will read out the oath and then ask you to swear or affirm to tell the truth.
  • Special care is taken with any witnesses who are:
    • children;
    • who have intellectual or other difficulties; and
    • those who need an interpreter.
