11. Witnesses at a Hearing

- You may be called as a witness in a hearing to give evidence. You may be a witness for:
- the objector;
- the complainant; or
- the applicant.
- If you are a witness for an objector or a complainant then he or she will firstly question you. If they have a lawyer then the lawyer will speak on their behalf.
- The applicant or their lawyer will then have a chance to ask you some questions.
- The commissioners may also ask you questions.
- If you are a witness in support of an applicant then he or she will firstly question you. If they have a lawyer then the lawyer will speak on their behalf.
- The complainant or their lawyer will then have a chance to ask you some questions.
- The commissioners may also ask you questions.
- If you are giving evidence at a hearing you must enter the witness box and take an oath to tell the truth to the commission.
- Usually the chairman or presiding commissioner will read out the oath and then ask you to swear or affirm to tell the truth.
- Special care is taken with any witnesses who are:
- children;
- who have intellectual or other difficulties; and
- those who need an interpreter.
