arties terminating a relationship can apply to a court for consent property orders without legal representation. However legal representation is essential for parties entering a BFA as the court is not involved. The terms need not be ‘just and equitable’ or fair in terms of the law but each party must have been advised on their rights and obligations. One or both parties may be advised that the terms are not fair but choose to proceed anyway. Your lawyer will guide you through the considerations necessary to choose from a well-informed position whether to enter a BFA.
