    8. Training for Workers
  • Under the law a key duty of a person conducting a business or undertaking (‘PCBU’) is to ensure the provision of information and training to workers to protect them and others from safety risks.
  • While the law does not spell out the form or content of such training the PCBU may be liable in the event of an incident for not having taken steps to reduce the risk of harm if some form of training is not provided.
  • In determining the type of training to be provided to workers a PCBU must have regard to:
    • the nature of the work carried out by the employee;
    • the nature of the risks associated with the work;
    • the control measures implemented; and
    • whether the training is readily understandable and accessible by its audience.
  • Workers also have a duty to comply with any reasonable instruction given to them by the PCBU.
