4. Police Caution

  • If you offence is not serious or this is your first offence police may give you a ‘caution’ which is an official warning.
  • The caution is intended to emphasise the seriousness of your conduct while ensuring that you avoid the consequences associated with a criminal prosecution.
  • Not all jurisdictions allow police to decide whether to issue a caution. Legislation regulates the circumstances in which a caution can be granted in:
    • Queensland;
    • Western Australia;
    • South Australia; and
    • New South Wales.
