4. Police Caution

- If you offence is not serious or this is your first offence police may give you a ‘caution’ which is an official warning.
- The caution is intended to emphasise the seriousness of your conduct while ensuring that you avoid the consequences associated with a criminal prosecution.
- Not all jurisdictions allow police to decide whether to issue a caution. Legislation regulates the circumstances in which a caution can be granted in:
- Queensland;
- Western Australia;
- South Australia; and
- New South Wales.
