  • It is important that you act quickly if you have sustained injuries in a public place and would like to make a claim. There are strict limitation periods that apply to these claims. These limitation periods are imposed by law. In Queensland for example claims involving negligence and personal injury must be started within 3 years from the date of the accident.
  • It is very difficult to make a claim if you are outside the limitation period. A lawyer’s advice should be sought in these circumstances because you will need to make an application to the court to request an extension of the limitation period. This will not always be granted. You will need to provide a reasonable reason for missing the limitation period.
  • You need to check the relevant legislation in your state or territory as the rules are different in each jurisdiction.
