  • As the injured person making the claim you will be referred to as a ‘claimant.’
  • If your accident resulted from the negligence of another person you have a legal right to claim compensation for your injuries and associated loss.
  • Compensation is usually paid in the form of ‘damages.’ Damages are an award of money to be paid to a person as compensation for loss or injury. The amount of damages you are likely to receive will directly relate to the loss or damage you have suffered.
  • Damages are calculated by examining the impact of your injuries now and making a prediction about how they will affect you into the future. Serious injuries generally attract a larger award of damages and a wider range of available compensation.
  • Your injuries must have been directly caused by the accident. You cannot claim compensation for pre-existing conditions or injuries that were not caused by the accident. As an exception to this rule you may claim compensation for pre-existing injuries that have been made worse by the accident.
  • Not all injuries sustained in a public place are worth making a claim for. It depends on the nature of the injury, its severity and how it affects your daily life. It will also depend on whether you can prove that the other party was liable (responsible) for causing your injuries.
