· If you are involved in a motor vehicle accident you are required to swap your ‘particulars’ with all other parties involved. Such particulars include:
o your name and address;
o the name and address of the owner of the vehicle (if different from the driver);
o the vehicle registration; and
o any other details particular to the vehicle’s identification.
· Police will not attend the scene of an accident unless there is serious injury or a fatality involved.
· By law the driver of a motor vehicle involved in any accident is required to stop, exchange contact and insurance details and provide all reasonable assistance.
· Compulsory Third Party insurance will provide cover for claims of personal injury made against the driver of the vehicle.
· Other types of insurance are available to cover claims for property damage.
· Insurance cover should be checked closely as there will be certain circumstances in which the cover will not be provided because of factors including:
o the status of your driver’s licence;
o intoxication; or
o a failure to provide the insurer with your correct details.
· You should take photographs of both vehicles in the accident and record the number plates of all vehicles involved.
· You should also take down the details of any person who has witnessed the accident as well as the details of any people who provided assistance.
· These details will be important if there is a dispute about who is to blame for the accident.
· See our topic on Vehicle & Motor Accidents Law for a more detailed discussion of these issues. Our Public Place Claims Overview Guide also contains more information about making claim where insurers are involved.
