9. Foreign TM Protection

- You may file for trade mark registration in foreign countries by filing:
- a national trade mark application in each country of interest;
- a single Community Trade Mark application (CTM) for the European Union countries; or
- filing an application for International Registration through the Madrid system for countries which are signatories to the Madrid Protocol.
- An International Registration application can be filed through IP Australia.
- The International Registration is often perceived as a more cost effective option. However this very much depends on issues such as the particular countries of interest and whether objection in the foreign country is likely. An applicant should carefully consider and settle on a foreign filing strategy before initiating foreign protection.
