  • To apply to register a trade mark you will need to provide your:
  • full name;
  • business address; and
  • nationality for an individual; or
  • place of incorporation and Australian Company Number for a company.
  • An outline of the kinds of goods and services you wish to protect is also required.
  • There are 34 classes of goods and 11 classes of services. 
  • Multi-class applications are permitted. 
  • Preparing a goods and services specification can be complicated as there is a balance between claiming a broad range of goods and services for broad protection and describing the goods and services with sufficient accuracy.
  • It is very important that the goods and services specification has been well considered because expansion later is not permitted and the specification may form the basis of your foreign protection if you later seek protection in foreign markets.
  • A good quality representation or image is required if the trade mark includes something other than plain words in non-standard form or if it includes:
  • a logo;
  • a device; or
  • a symbol.
