4. Wilful Damage to Property

- The offence of wilful damage relates to damage caused to public or private property where the damage done is under the value of $5000.
- This offence is a summary offence. This means it can be dealt with by a magistrate in the Magistrates’ Court.
- Wilful damage is the least serious of these types of offences. The sentencing options available range from a fine for minor offending through to imprisonment for more serious offences.
- Wilful damage may also be referred to as vandalism. It may cover a wide range of behaviour from graffiti to breaking a window or fence to dumping rubbish in the bush or on the side of the road.
