ICriminal Property Damaget is a criminal offence in each state and territory to damage or destroy property that belongs to others. These types of offences may be referred as ‘criminal damage’ or ‘wilful damage.’ If property is destroyed by fire it is called ‘arson.’

These types of offences are broadly categorised. Less serious criminal damage offences are dealt with in a lower court such as the Magistrates’ or Local Court. More serious criminal damage offences are dealt with in a higher court such as the District or County Court. The most serious of these offences is arson causing death. This offence is heard in the Supreme Court and is similar to manslaughter in terms of the penalties involved.
