- The National Native Title Tribunal (NNTT) advises public bodies whose interests may be affected by an application for native title such as state governments.
- Parties whose interests are affected can apply to the court to become respondent parties.
- The types of interest that might be affected include interests granted by a licence or lease over the Crown land or water.
- The process takes three months and is called a notification period.
- Following the notification period the court decides who are respondent parties to the case.
- If the parties to a claim can reach an agreement for a determination of native title the court can make a determination of native title consistent with that agreement.
- If an agreement is not reached the court will hold a hearing and determine whether native title exists.
