5. Urgent Fence Repairs

middot; There are many situations where damage is caused to a fence that needs immediate repair to avoid further damage, loss or to maintain security.
· An owner can carry out the work without first issuing a fencing notice if the circumstances make it impractical to do so. This may happen where a fence has been damaged or destroyed and the repairs are urgent under the circumstances.
· The neighbour on the other side of the fence will still be liable for half the expense but this is open to review by the relevant tribunal, Magistrates' Court or Local Court at a later stage.
