  • If a consumer does not have the time or funds to privately sue the manufacturer they can make a complaint to the relevant consumer body for their jurisdiction or federally to the Australian Competition and Consumer Commission (ACCC). The ACCC is responsible for regulating compliance with the Australian Consumer Law. The ACCC has the power to decide whether or not the complaint is serious enough for them to consider taking action on behalf of the consumer. Usually the regulators will take action against a manufacturer if the defective product has caused widespread detriment for example if the product places more than one consumer at risk of harm.
  • You can also make a complaint to the consumer regulator in your state or territory such as Consumer Affairs Victoria (CAV) or the Office of Consumer and Business Affairs in South Australia.
