  • In some situations you will receive a warranty with a product that you purchase. It is important to understand that any warranties are above and beyond the rights that you already have as a consumer. It is unlawful for a business to try to limit any of the rights that are provided to consumers under the Australian Consumer Law.
  • You are also unable to waive your rights as a consumer under the Australian Consumer Law. If you have a contract relating to a product you have purchased in which a manufacturer or supplier is attempting to avoid responsibility for any product defect it is highly likely that this particular clause of the contract is not valid.
  • In some situations you will still have rights to compensation even though a product warranty has expired. For example if you purchase a television that breaks after 12 months of use and the warranty has expired you will still have rights under the Australian Consumer Law as it would be reasonable to expect that the television was of a quality that would last more than 12 months. The basis of your complaint may be that the television was not of acceptable quality.
