8. The Tribunal Decision

- When the Dust Diseases Tribunal makes a decision about your case is binding on all parties
- According to section 32 of the Dust Diseases Tribunal Act 1989 (NSW) if any party is unsatisfied with the decision because of a dispute over a point of law or the admission or rejection of particular evidence then they may appeal to the Court of Appeal.
- You should always get expert legal advice before making any decision to appeal to a higher court. Appeal is a costly process and the unsuccessful party may be required to pay the other party’s costs.
