What is an Indigenous Land Use Agreement (ILUAs)?

  • An ILUA is a voluntary agreement between the native title claim group and others about how the land or water is used.
  • The ILUA can cover:
    • areas where native title has already been found to exist;
    • situations where the court is still deciding if native title exists; and
    • land where no native title claim has been made.
  • An ILUA is registered on the Register of Indigenous Land Use held by the National Native Title Tribunal (NNTT). A registered ILUA binds all persons who hold native title to the terms of the agreement whether they were parties to the agreement or not.
  • ILUAs provide certainty for other parties who wish to carry out activities and developments on the land or waters in the agreement area even before native title has been determined.
