What steps need to be taken to respond to a writ and statement of claim?

  • If you have been served with a writ and a statement of claim this means that another person or business has started a civil case against you. You will be named as the defendant on the relevant documents.
  • You will need to file some documents with the court in response to the claim.
    • Generally you will need to file a:
      • notice of appearance;
      • notice of defence; and
      • possibly a counterclaim.
  • Usually you can get these forms from the court registry.
