What steps need to be taken to respond to a writ and statement of claim?
- If you have been served with a writ and a statement of claim this means that another person or business has started a civil case against you. You will be named as the defendant on the relevant documents.
- You will need to file some documents with the court in response to the claim.
- Generally you will need to file a:
- notice of appearance;
- notice of defence; and
- possibly a counterclaim.
- Usually you can get these forms from the court registry.
