What happens if we have to go to mediation?

  • In some states and territories the law requires parties to go to mediation before they can have their civil case listed in court.
  • This means that you and the other party will have to go to a mediation session to try and sort out your disagreement without the need for a court case.
    • The mediator is independent and their job is to help you to come to an agreement.
    • At mediation both parties will get a chance to tell their side of the story and explain what they want and why.
    • You can bring a lawyer along to help you.
  • You will need to check the rules where you live to see how the law applies and exactly what forms you will need to give to the court to prove that you have tried mediation.
