- Research and identify which ADR process will best suit your circumstances.
- Research and identify a suitable ADR service provider or practitioner.
- Prepare your material before you attend an ADR session:
- familiarise yourself with the process;
- gather any documents that may be relevant;
- think about the key issues of concern you may have;
- think about what the other party may want; and
- prepare your opening statement.
- It is a good idea to write these things down as when you are in the process it can be easy to forget things.
- Find out about the costs. Usually ADR practitioners charge an hourly rate or a lump sum payment. Find out the applicable rate and the approximate number of hours if it is an hourly rate.
