  • Ensure that you have contracts with people you work with who may be creating works. This includes:
    • employees;
    • independent contractors; and
    • creative agencies.
  • In order to protect leakage of your copyright ensure that each contract specifically covers intellectual property.
  • It is important to understand basic copyright facts. There are many copyright myths including the myth that you are permitted to use 20% of a work. It is very easy to obtain inspiration from the internet so ensure that your designers have a basic understanding of what is and what is not permitted.
  • When it comes to enforcing copyright you will need to prove that you own copyright. As well as establishing ownership through assignment you will need to prove:
    • who created the works;
    • when; and
    • where.
  • Clear records at the time of creating the work will greatly assist at the time of enforcement. These may be required years after the creation of the work so should be stored carefully.
