6. Unexplained Wealth Orders

    6. Unexplained Wealth Orders
  • If there are sufficient grounds to suspect that your total assets exceed the value of your legally obtained assets a Preliminary Unexplained Wealth Order can be granted by a Magistrate.
  • The authorities must advise you in writing of a Preliminary Unexplained Wealth Order. They must also give you a copy of the application for the Unexplained Wealth Order as well as any supporting materials.
  • You can apply to the court to have the order revoked within 28 days of receiving the order.
  • The court has the power to revoke the order where it believes there are no reasonable grounds on which to make the order.
  • If the court revokes the Preliminary Unexplained Wealth Order you should ensure that you have been notified in writing before you resume dealing with your property in any way.
