  • Before signing you should instruct your lawyer to check that the lease contains everything that was agreed to during negotiations including the agreed terms and conditions you requested. Your lawyer will also check for any ‘last-minute’ terms or conditions that have been inserted.
  • Ensure any verbal promises have been included in the document.
  • The lease is binding on you and the landlord once you have both signed.
  • Retail leasing laws in many states and territories outline the landlord’s obligations before the lease is signed. Ask your lawyer to check that these are complied with.
  • State and territory retail leasing laws also list the types of conduct that are illegal especially prior to the lease being signed. Parties are expected to:
    • be honest;
    • not resort to threats; and
    • provide each other with up to date information.
