  • Anti-competitive agreements are contracts, arrangements or understandings that substantially reduce competition or have the potential to do so. These kinds of agreements are prohibited under the Competition and Consumer Act 2010 (Cth).
    • Whether an agreement does 'substantially reduce competition' is a complex matter as is determining the relevant 'market'.
    • Usually an 'effect' is considered to be substantial if it is important or carries weight in the market.
