A2. How a Lawyer Can Help lawyer can assist you before you enter into a binding insurance contract by:

  • explaining your obligations under the contract;
  • explaining what is covered under the contract;
  • establishing whether the contract is suitable for you; and
  • reviewing a signed contract within the ‘cooling off’ period. This is the period after signing the contract during which you may cancel it.

A lawyer can assist you in a dispute with an insurance provider by:

  • assisting you in applying for an internal review by the insurer;
  • negotiating with the insurer on your behalf;
  • assisting you in making a complaint to the Financial Ombudsman Service (FOS);
  • advising you of your options for taking the matter to court;
  • representing you in any court hearing; and

assisting in enforcing a decision made against the insurer by the FOS or a court.
