What happens if the agreement we reach at the commission or tribunal is breached?

  • This will depend on the jurisdiction. In some states or territories an agreement is binding as soon as it is made. In other jurisdictions the agreement needs to be written down and signed. In others it may need to be stamped by the tribunal to become legally binding (enforceable).
  • You should confirm with the conciliator whether anything needs to be done to make your agreement binding.
  • If a party breaches a binding agreement you can ask the relevant tribunal or commission to enforce the agreement.
