What cannot be registered as a trade mark?
- A trade mark that describes your goods or services or their characteristics cannot be registered. For example:
- High Heel Shoes;
- Swedish Furniture; or
- Paperback Books.
- A trade mark that uses a description that is customary in your line of business cannot be registered. For example:
- Baked Bread;
- Natural Gas; or
- Flat Screen TVs.
- A trade mark that uses a common description but which intentionally misspells some of the words also cannot be registered. For example:
- Plaztic Rap; or
- Kat Food.
- A trade mark will also be rejected if it:
- includes offensive words or images;
- is against the law in any way for example promoting illegal activities; or
- is misleading or deceptive for example attempting to persuade the public that your goods and services have a quality which they do not.
