What are by-laws?
- By-laws are rules that are made to facilitate the smooth running of a community scheme.
- Some issues that are regulated through the use of by-laws include:
- exclusive rights to use property;
- road rules within the community scheme;
- garbage;
- pets;
- parking;
- noise; and
- nuisance.
- All residents in a community scheme and its subsidiaries must abide by the scheme’s by-laws. Subsidiary schemes will generally have their own set of by-laws that will also need to be complied with.
- Failure to observe these rules can lead to penalties or fines being issued by the NSW Civil and Administrative Tribunal (NCAT). You may be fined be up to $550.00 for a serious breach of the by-laws.
