Can a serious offence be dealt with in a lower court?

  • Some indictable offences are called ‘indictable triable summarily’. This means that the parties can choose or a magistrate can order that an indictable offence to be heard and determined in the Magistrates’ or Local Court.
  • Sometimes this issue can form part of your plea negotiation. For example you may offer to plead guilty to a charge if the prosecution agree that it should be dealt with in a lower court.
