If a person breaks the law in one state can they be made to go to court in another state?
- Yes. If a person is arrested under a valid warrant they will be taken to court in the state or territory where they were arrested. It does not matter which state or territory the warrant came from.
- The magistrate may then:
- make an order for the person to return to the state where the warrant was prepared; or
- give the person bail and enable them to make their own way to the interstate court.
