Would the outcome be different if one of the spouses stopped working?

A couple both aged over 55 carry on business owning two shops. They sell one of the shops but carry on their business through the other shop.

Since the nature of their work continues through the other shop they will probably be considered as having sold the first shop not in connection with their retirement.

If one spouse stops working altogether, the sale of the shop may be considered as sold in connection with the retirement of that spouse.
