As the victim of an offence can I decide that I want the charges against the accused to be dropped?

My husband is being charged with domestic abuse for hitting me. While I initially reported it to the police I have changed my mind and don’t want him charged as I need him to help support our family. I would like the police to drop the charges.

  • If the police investigate an offence and conclude that there is sufficient evidence to charge an accused they will take the matter to court.
  • The offence is considered as being an offence against the state therefore it is up to the prosecution to pursue justice on behalf of the state.
  • It is likely they will proceed with the charges despite your change of mind.
