What are the consequences of a court martial conviction?

I recently committed an offence. I pled not guilty but I didn’t have a strong case and now I fear I will be found guilty. What can I expect?

  • If you are found guilty by a court martial the Judge Advocate will pronounce sentence on you.
  • The punishment you may face will depend on what crime you have been found guilty of and whether there are any mitigating (excusing or reducing) or aggravating factors. Punishments may include:
  • imprisonment, dismissal, reduction in rank, forfeiture of any promotions or seniority, fine or reprimand for convicted officers;
  • imprisonment, dismissal, detention not exceeding 2 years, reduction in rank, forfeiture of seniority, fine or reprimand for other members of the ADF; and
  • imprisonment or fine not exceeding $500 for other people who are not members of the ADF.
