What does an Australian government agency need to advise me of before collating and using my personal information?
I was asked to provide certain personal information to Centrelink. I am not sure why they require this information and I haven’t been provided with any information regarding this. What type of information should have been provided?
Lawyer Answers (1): Answers from lawyers are general preliminary responses. They are not formal legal advice and cannot taken account of all your circumstances. They do not create a lawyer–client relationship.
- When collating or using personal information the organisation or agency is obliged to ensure a person is alerted to:
- the reason for which the personal data has been collected;
- whether the collection is required or permitted by law; and
- any specific agency, organisation or person that the personal information will possibly disclosed to.
- Companies and businesses should carefully consider how they intend to use or reveal an individual’s personal information. Generally they will be prevented from doing so without your express consent.
